Another Ebay woes question - Buyer annoyed broken ipod was broken

Hi All

After some advice, never had an ebay dispute before.

I sold an old 80gb Ipod, it was broken. I listed it as broken or spares and said in my description that I didn't think it could be repaired and was probably only good for some spares. I smashed the screen, made a hash of mending it, I said I didn't think anything was wrong with the battery or HDD. I also said no returns.

Sold it for �31, buyer paid and I sent.

He's come back today and wanted to return it, he says that he cannot repair it and wants his money back.

He has raised dispute.

It is clear that this guy has decided that he could get a bargain by buying up broken ipods and doing a minor repair (like fitting a new screen). This one cannot be repaired and he just sends them back.

Anyone got any experience of this issue or issues with the resolution centre.

I just stated my case in response, as a gesture of goodwill I offered a partial refund less a �15 restocking and inconvenience fee.

I have a 100% positive feedback of 184, so a neg from this guy isn't going to kill me, I'm going to get negged no matter what I do.

Any thoughts?

Screw him. You stated clearly what he was buying, he's trying to gyp you.
Don't refund him - Email eBay and explain, and respond to the neg if he has the nerve to do so.

Thanks, yes its fairly obvious that he is trying it on.

I'm struggling to not be sarcastic in my replies, I said it was probably unrepairable and his issue seems to be he has received an ipod that is unrepairable. Want to sound professional when ebay come to settle the dispute though, but the only way I'd refund would be if he returned it and it wasn;t broken and worked fine.

Well he raised a dispute which I responded to. He seems to know what he is doing and his complaint seems to be that I didn't list exactly what the problem was. I should have said it had a faulty screen connector on the motherboard.

Had it been an easy thing to fix, I would have done so myself.

But heard horror stories of them siding with the buyer on things like this. So am a little concerned

I sold an old iphone and listed it as damaged/spares - I think he's trying it on and trying to bend the rules to suit himself here.

You're no expert, no where under ebay rules does it say you have to explain the fault exactly, I'm no techie so you just say damaged... he bought it knowing this and no w decided he doesn't want it.

Email ebay and explain, don't offer him a refund, it's his mistake if he can't fix it, not yours for selling a damaged item (which you clearly explained as such).

Thanks Andy, looking into it, it apparently needs to be significantly not as described. So as far as the rules go, I sold a broken ipod, a broken ipod was received.

Well his latest comments to my 1000 character reply is that he wants a refund and a bit of profanity mixed in.

Well after his many responses asking for a refund and my eloquent replies to him, we were getting nowhere so I escalated it to ebay to make a decision. Common sense prevailed and they sided with me.

Apparently if a broken ipod that can't be repaired, cannot be repaired, then that is the item described correctly.

So its probably took about 4 hours of my time, but at least I won

I'm surprised you didn't get screwed over as that's what normally happens.

Thanks, tbh I imagine 9/10 a seller would back down and have given a refund, I'll know for next time to stand my ground. But in over 300 transactions I don't think it ever happened before

When I saw this thread had popped back to life I thought for one awful moment that I was going to read he was taking you to the small claims court. He sounds that sort.

I sold a broken camera lens with a massive red bit of text saying it was broken and for spares or repair.

Paypal refunded the buyer even before he returned the lens....

Sold a zelda gamecube game as in perfect condition as it was new and sealed. Buyer argued that it wasn't as perfect as he had wanted as there was a 2mm tear in the wrapper. I argued that I hadn't sold the wrapper and that the game inside was in perfect condition as per the description. EBay sided with the buyer. And because I disputed it, you don't get fees back either. Joke!
