Does the Joker ever take his top off anyway? Hoping its all a bit of a moot point, and that they just don't want to show what he'll actually be wearing.

Quite. Even if he does once, whatever. It's certainly annoying but, ultimately, his head, costume and manner is what's important.

Maybe they're prison tats from one too many stints in Arkham.
I love Leto for the role although if this is a world in which Batman's been around for donkeys years and is played by a slightly aged up Affleck (greying hair, been round the block etc) then shouldn't his mortal enemy be around that age too?

There's now a different pic doing the rounds showing Leto without the "Damaged" forehead tattoo, so maybe the ink was just for this promo shot. I hope so.
For the record, I think Leto is an outstanding choice for the Joker.

Could be that Suicide Squad (and maybe the solo Batfleck film) is set years before Batman V Superman.

someone did a mock up with cloths on ( minus the "Damaged" Tat ) which makes it all seem so much better, that original pic is a mess, Im kinda hoping its a "Joke"

I think this was sniped by a photographer taking photos of Jared Leto showing someone else photos or video on his mobile phone before the recent official photo was released:
I'm not sure if the still images have been animated to create this effect but you can see a white suite with dark trim, him raising a gun to his head and laughing... it's too poor quality to tell if he has a tattoo on his forehead!
